Memorandum of understanding between the Ministry of Foreign Affairs of the State of Palestine and the Ministry of Foreign Affairs of the Republic of Cuba

The Ministry of Foreign Affairs of the State of Palestine and the Ministry of Foreign Affairs of the Republic of Cuba referred to hereinafter as "contracting parties"

Desirous to direct the policy of both countries towards supporting peace and international security pursuant to the principles and the goals of the United Nations Charter, and their interest in the settlement of the basis of cooperation between them , with the aim of studying the most important aspects in their bilateral relations , and the regional and international issues , they have agreed as follows

Article 1

Both parties work, periodically, on organizing discussions and consultations on the level of Ministers, Under- Secretaries, managers and experts in both Ministries, and working groups, established on basis of equal representation with the aim of studying the issues of mutual interest, shall be established


Article 2

Determining the venue , the date, the agenda, and the level of consultations, through the diplomatic channels, and both parties work on organizing consultations periodically pursuant to principles of reciprocity, and organizing meetings on the level of Ministers , or the representatives whenever it is necessary in a date to be agreed upon by both parties , and the meeting shall be held on the level of the Under- Secretaries , managers ,and the experts or their representatives or whenever it is necessary


Article 3

The discussions and consultations between both parties will tackle the following fields

I- Bilateral relations including the economic and political aspects
II- The recent events in the international politics including the disarmament and the international security
III- Current disagreements and disputes, especially that escalate or may appear in the future
IV- Supporting the positive role of the United Nations Organization and the other organizations, regarding solving the issues and the crises that the international group may face
V- The issues inserted in the agenda of the United Nations Organization, the other international organizations, and the conferences, including the one related to coordinating the attitude towards these issues
VI- International cooperation in the commercial, economic, practical, technical, and cultural affairs as well as environment protection and the other non- similar fields
VII- Organizing seminars, workshops, and the other similar training programs
VIII- Any other fields, that both parties consider it necessary to exchange opinions on


Article 4

The representatives of both parties , approved in the United Nations and the other international organizations in a constructive way , with the aim of coordinating efforts in the issues of mutual interest and supporting the candidates of the State of Palestine and the Republic of Cuba in the international organizations , pursuant to the principle of reciprocity

Article 5

Both parties agree on approving ways and additional procedures, with the aim of intensifying and enlarging the scope of bilateral cooperation between them, whenever it is necessary


Article 6

It is possible to amend and revise this memorandum in writing if both Ministries see that


Article 7

The memorandum shall enter into force as of the date of signing it and it will remain in effect for a period of five years, and to be renewed automatically for a year, unless one of the parties informs the other with his desire to terminate it, before six months of its expiry date


This memorandum of understanding was signed in the city of Jerusalem on 5-8-1430 A.H "31-12-2009" in three original copies in the Arabic, Spanish, and English languages, all the texts have the same authenticity, and in case of any difference in interpretation, the English version shall prevail

استفدت من مراجعة الترجمة المقترحةى بترجمتي عدة أشياء :
1- ترجمة الفعل المساعد shall فعند إتصال هذا الفعل بفعل رئيسي من " determine" فإنني بدلا من أن أقوم بترجمة " shall determine" ب" يقوم بتحديد " فإنني من الافضل أن أترجمها " يحدد " رأسا.
2- استفدت أن من بين معاني كلمة " channel " طريق
3- استخدام ما قل و دل من الكلمات
استفدت من الورشة عدة اشياء أهمها:

1- معرفة الكثير من الأخطاء اللغوية في اللغة العربية
2- الفوائد اللغوية التي أثرى بها السادة الأعضاء المنتديات
3- قاعدة ذهبية كان قد علمنا إياها الأستاذ " حسام الدين مصطفى " في دورة " الترجمة الدبلوماسية و السياسية ألا و هي : " البحث في القاموس عن معاني كل الكلمات ، حتى تلك التي نعرف معناها ، فلعل هناك معاني أخرى أكثر مناسبة للسياق الذي نترجمه و قد ساهمت هذه الورشة في تعميق هذا المفهوم لدي

لدي سؤالان :

ترجم الأستاذ عامر العظم كلمة " develop " " تعزيز " في حين لم أجد كلمة تعزيز ضمن معاني هذه الكلمة ؟

Memorandum of Understanding between the Ministry of Foreign affairs of the state of Palestine and the Ministry of the foreign affairs of the Republic of Cuba

The ministry of foreign affairs of the state of Palestine and the ministry of foreign affairs of the Republic of Cuba herein below referred as "the Parties", both countries are aspiring to strengthen peace and international security in accordance with the principles and objectives of the United Nations charter and their interest in consolidating a bilateral cooperation for the purpose of considering the main issues of their bilateral relations as well as the regional and international issues of mutual interest ,have agreed as follows

Article 1

Both parties shall hold organised discussions and consultations periodically between the ministers, deputy ministers, managers and experts of both respective ministries as well as forming working groups, based on the principle of equal representation to study issues of mutual interest

Article 2

Determining the venue, date, agenda and level of the consultations through diplomatic channels, both parties shall hold regular consultations on the principles of regularity and rotation. Meetings between ministers or their representatives will be held with the consent of both parties if needed. The meetings will be convened annually at deputy ministers' level, managers, experts or their representatives or whenever deemed necessary

Article 3

Discussions and consultations will be dealing with following areas

I- Bilateral relations including economic and political issues
II- Latest developments concerning international policy including disarmament and international security
III- Disputes and ongoing conflicts especially those rising up or may emerge in the future
IV- Encouraging the positive role of United Nations & other international organisations in respect of resolving issues and crises facing the international community
V- Issues included on the agenda of the United Nations organisation and other international organisations. Those discussions incorporate the arrangement of stances concerning the relevant issues
VI- International cooperation in the related issues of commercial, economic, practical, technical, cultural and environmental protection and other different fields
VII- Convening symposium, workshops and other similar training activities
VIII- Any other fields which are deemed important by both parties to exchange their point of views

Article 4

The representatives of the two parties accredited at the United Nations organisation and other international organisation shall cooperate constructively to make a real effort on issues of mutual interest. Both parties shall garner support for the candidates of the State of Palestine and the Republic of Cuba in international organisation according to the principles of regularity and rotation

Article 5

If needed, the two parties shall agree to adopt further procedures and steps for the concentration and expansion of the mutual cooperation between them

Article 6

The memorandum can be amended or revised in writing if both ministries consider it appropriate

Article 7

This memorandum enters into force since the date of signature and remains valid for five years. It will be renewed automatically for one year unless neither party notifies the other party of its intention to terminate the memorandum six months prior to its expiry

Done in Jerusalem at 5/8/1430 corresponding to 31/12/2009 in triplicate, each of which in Arabic, Spanish and English. All texts being equally authentic, in case of divergence, the English text shall prevail

Memorandum of understanding
Between
The foreign Ministry of the State of Palestine
And the Foreign Ministry of Cuba

The foreign ministry of the State of Palestine and the foreign ministry of Cuba hereinafter referred to as “the parties”
Desirous to direct the policy in both countries towards peace reinforcement and international security
Pursuant to the goals and principles of the charter of the United Nations
Considering it important to consolidate cooperation between them in order to scrutinize most important aspects in their bilateral relation, as well as, international and regional causes of mutual interest

Have agreed as follows


Article 1

Both parties shall organize regular talks and consultations at the levels of ministers, undersecretaries, directors and experts. Moreover, working groups based on the concept of equal representation shall be formed in order to scrutinize issues of mutual interest


Article 2

The venue, date, agenda and level of consultations shall be determined, according to the principle of reciprocity, through diplomatic channels. Both parties shall, if needed, conduct meetings at the levels of ministers or their representatives on a pre-agreed date. These meetings shall be held on yearly basis or whenever necessary at the levels of undersecretaries, directors, experts or their representatives


Article 3

Discussions and consultations between both parties shall deal with the following subjects

I- Bilateral relations including economical and political aspects
II- The updated events of the international policy including demilitarization and international security
III- Current disputes and differences especially the one that might emerge in the future
IV- Enhance the positive role of the United Nations and other international organizations regarding the solutions of problems facing the international groups
V- Listed causes in the agenda of the United Nations Organization, other international organizations and conferences
VI- International cooperation in trading, economical, practical, artistically, cultural and environment protection issues, as well as, other different specialties

Considering it important to consolidate cooperation between them in order to scrutinize most important aspects in their bilateral relation, as well as, international and regional causes of mutual interest

Have agreed as follows


Article 1

Both parties shall organize regular talks and consultations at the levels of ministers, undersecretaries, directors and experts. Moreover, working groups based on the concept of equal representation shall be formed in order to scrutinize issues of mutual interest


Article 2

The venue, date, agenda and level of consultations shall be determined, according to the principle of reciprocity, through diplomatic channels. Both parties shall, if needed, conduct meetings at the levels of ministers or their representatives on a pre-agreed date. These meetings shall be held on yearly basis or whenever necessary at the levels of undersecretaries, directors, experts or their representatives


Article 3

Discussions and consultations between both parties shall deal with the following subjects

I- Bilateral relations including economical and political aspects
II- The updated events of the international policy including demilitarization and international security
III- Current disputes and differences especially the one that might emerge in the future
IV- Enhance the positive role of the United Nations and other international organizations regarding the solutions of problems facing the international groups
V- Listed causes in the agenda of the United Nations Organization, other international organizations and conferences
VI- International cooperation in trading, economical, practical, artistically, cultural and environment protection issues, as well as, other different specialties
VII- Conduct seminars, workshops and other similar training activities
VIII- Any other different field that considered necessary for both parties to exchange points of views

herein after referred to as the "contracting parties"

This meeting shall be attended by both the Prime ministers and the managers and experts or their representatives annually or whenever deemed necessary

Article 3

The discussions and talks between the two parties tackles the following fields
I – bilateral relations including military and economic fields
II - The new events in the international politics including disarming and international peace
III- Current disputes and disagreements, specially those arising or might arise in future
IV- Enforcing the active rule for both the United Nations organization and other international organizations about solving issues and crisis that arise to the international group
V- Issues listed in the agenda of the United Nations organization and the other organizations and conferences and conferences including those related to arranging situations about those issues
VI- International cooperation in the commercial, economical, practical, technical, educational and environmental affairs and in other fields beyond relative ness
VII- Arranging conferences and workshops and other training activities
VIII- Any other topics that are deemed to be necessary for exchanging views around it

Article 4

Both the certified representatives of the two parties shall cooperate in the united nations organization or the other international organizations actively in order to arrange efforts in the issues of mutual interest and in order to afford support to the candidates of both the states of Palestine and Cuba in the international organizations and according to the principles of regularity and rotation

Article 5

Both the two parties shall agree upon certifying additional methods and procedures in order to intensify and expand the ambit of mutual cooperation whenever deemed necessary

Article 6

Any amendment or editing of this memorandum is allowed in a written context if both the ministries agreed upon that

Article 7

This memorandum shall enter into force starting from the date of signing upon it and remains into force for five years that are automatically renewed for only one year, unless one of the two parties informs the other party about his intention to end it before six months from the expiration of the validity period

Memorandum of Understanding between the Ministry of Foreign Affairs of the State of Palestine and the Ministry of Foreign Affairs of the Republic of Cuba

The Ministry of Foreign Affairs of the State of Palestine and the Ministry of Foreign Affairs of the Republic of Cuba hereinafter referred to as "the Two Parties";

- having the desire to orient their policies for enhancing peace and international security according to the principles and goals of the United Nations Charter,
- concerned with stabilization of the cooperation basis between them in order to examine the most important aspects in their bilateral relationships and the regional and international issues of mutual interests

have agreed on the following


Article One

Both Parties shall hold negotiations and consultations regularly on the level of ministers, deputy ministers, directors and experts in both Ministries. Work groups shall be constituted upon the equal representation to study the issues of mutual interests


Article Two

The place, dates, agenda and level of consultations shall be determined through the diplomatic channels. The Two Parties shall organize the consultations regularly upon the reciprocal basis as well as organization of meetings on the levels of ministers or their representatives whenever necessary on agreed dates. The meetings on the levels of deputy ministers, directors or experts shall be held annually or whenever necessary


Article Three

The discussions and consultations between the Two Parties shall cover the following fields

I - The bilateral relationships including the political and economic aspects
II - Emerging events in the international arena including disarmament and international security
III - The current disputes and conflicts particularly those disputes going up or merging in the future
IV - Promotion of the positive role of the United Nations Organization and other international organizations in respect of solving issues and crises faced internationally
V - The issues included in the agenda of the United Nations Organization and other international organizations and conferences including the coordination of standings in respect of such issues
VI - International cooperation in the commercial, economic, operative, cultural, technical and environmental matters and in other fields
VII - Organization of symposiums, workshops, and other similar training activities
VIII - Any other fields considered necessary for exchanging views by the Two Parties


Article Four

The representatives of the Two Parties accredited in the United Nations Organisation or in other international organizations shall cooperate constructively to coordinate the efforts in respect of the issue of mutual interests and providing support for the candidates of the State of Palestine and the Republic of Cuba in the international organizations on reciprocal basis


Article Five

The Two Parties shall agree on other ways and additional procedures to intensify and expand the scope of bilateral cooperation whenever necessary


Article Six

This Memorandum may be amended or revised in writing if the two Ministries find that appropriate


Article Seven

The Memorandum shall enter into effect from the date of signing and shall remain in effect for five years and shall be renewed automatically for one year, unless either Party informs the other for termination of the Memorandum by a written notification six months prior to its expiry


Signed in Jerusalem on 5/8/1430 H, 31/12/2009 in three originals in Arabic, Spanish and English. All texts shall have the same authenticity. In case of any divergence of interpretation, the English text shall prevail

2- الدقة في اختيار الكلمات (مراعاة الألفاظ والمصطلحات الدبلوماسية).
3- اختيار الكلمات المناسبة.
4- أخطاء في الترجمة تستحق الذكر (ليس من الضروري ذكر كل الأخطاء بالتفصيل الممل).
5- جملة أعجبتك ترجمتها.
6- كلمات جديدة تعلمتها من ترجمات الإخوة والأخوات.

نبدأ بعون الله تعالى مناقشة ترجمات الإخوة والأخوات الكرام للجلسة الرابعة من جلسات ورشة ترجمة مذكرات التفاهم الدبلوماسية.

لكن لا بد لي قبل أن أبدأ من شكر الإخوة والأخوات الكرام على مشاركاتهم, فقد استفدت من قراءة ترجماتهم استفادةً عظيمة, والأخطاء التي سنتحدث عنها ليست طعناً في قدرة أي شخص, وإنما هي للاستفادة والإفادة.


أولاً:

التزم الأخ الكريم بشير الشعبي والأخت الكريمة خولة عمورة باستعمال (shall) في معظم المواضع عند ترجمة مذكرة التفاهم الأخيرة. أٌهنأهما على ذلك.

لكن التزام بعض الإخوة والأخوات بذلك كان يتراوح من جملة إلى أخرى, فتارةً نراهم يستخدمون (shall) وتارةً أخرى يستخدمون (will) وتارةً ثالثة لا يستخدمون (shall) في الجملة.

أضرب أمثلة على ذلك:

ترجمت الأخت الكريم مها دحا المادة الثانية على النحو التالي:

Determining the venue, date, agenda and level of the consultations through diplomatic channels, both parties shall hold regular consultations on the principles of regularity and rotation. Meetings between ministers or their representatives will be held with the consent of both parties if needed. The meetings will be convened annually at deputy ministers' level, managers, experts or their representatives or whenever deemed necessary

ترجمة رائعة, لكن الأخت الكريمة مها دحام استخدمت (shall) في ترجمة الجزء الأول من هذه المادة, في حين استخدمت (will) مرتين – سهواً - في ترجمة الجزء الثاني من هذه المادة, وهذا – فيما أعلم - لا يجوز في عرف النصوص القانونية والدبلوماسية, والصحيح استخدام (shall).



مثال آخر هو ترجمة الأخت الكريمة منى شاذلي للمادة الأولى:

Both parties (missing shall) work, periodically, on organizing discussions and consultations on the level of Ministers, Under- Secretaries, managers and experts in both Ministries, and working groups, established on basis of equal representation with the aim of studying the issues of mutual interest, shall be established

سهت الأخت الكريمة منى شاذلي أثناء ترجمة هذه المادة, ونسيت استخدام (shall) في ترجمة الجملة الأولى, في حين نلاحظ أنها استخدمتها في ترجمة الجملة الأخيرة.



مثال ثالث هو ترجمة الأخ الكريم محمود ريان للمادة السابعة:

This memorandum shall enter into force starting from the date of signing upon it and (missing shall) remains into force for five years

استخدم الأخ الكريم محمود ريان (shall) في ترجمة الجزء الأول من الجملة المبينة أعلاه, لكنه نسي استخدامها في الجزء الثاني, بل استخدم الحاضر البسيط (present simple).

لم يستخدم الأخ الكريم الأستاذ نضال سيف الدين خالد (shall) في ترجمته للجلسة الأخيرة, بل استخدم (should), ومع أن (should) تُفيد الإلزام, فإن الأصح – والله أعلم - استخدام (shall) لهذا الغرض في الترجمة القانونية والدبلوماسية.


وأقتبس كلام الدكتور دنحا طوبيا كوركيس عن استخدام (shall) حين يقول:

لو طلب مني أحد ترجمة "إنّ" في الجملة التالية: (إنّ العراق عظيم برجاله), لقلت له بأنها لاتترجم، في حين أنها تفيد التوكيد. ومثلها (shall) في اللغة القانونية الانجليزية، فهي تفيد "المستقبل" شئت أم أبيت، ولكن لها "قوة قانونية"، (authoritativeness) بما لايقبل التأويل، ويمكن التعبير عنها بفعل مضارع، أو فعل ساند آخر على شاكلتها مثل (must) أو (should). ولكن لتمييز لغة القانون، كضرب خاص في الأسلوب البريطاني، يتهافت سدنة اللغة على المحافظة عليها، في حين أن المحدثين يحاولون الإجهاز عليها تماما. ويبدو أنها في طريقها إلى الزوال كما يتضح من لغة الأرقام في استخدامها حسب معطيات البنك البريطاني للمكتنزات اللغوية. ولما لم تكن هذه المفردة معجمية، فالسياق وحده هو دليل المترجم الناجح.

أرجو من جميع الإخوة والأخوات الكرام مراجعة النقاش الهام الذي جرى بين المترجمين الخبراء حول استخدام (shall) في الترجمة القانونية والدبلوماسية وكيفية ترجمتها على الرابط التالي:

ثانياً:

أشار الأستاذ عامر العظم في المشاركة رقم (75) في الصفحة الثالثة إلى أهمية التمييز بين أنظمة الحكم المختلفة.

ترجمت الأخت الكريمة خولة عمورة – سهواً – (Republic of Cuba) بـ(كوبا), فنسيت ترجمة كلمة (Republic) بـ(جمهورية), وقد يبدو الأمر هيناً لو كان هذا الخطأ في غير الترجمة الدبلوماسية, لكن الدقة هنا مطلوبة.

وسهى الأخ الكريم محمود ريان في بداية المذكرة عن ترجمة كلمة (جمهورية), لكنه ترجمها في الموضعين الآخرين في المذكرة بـ(State), وهذا خطأ لا يجوز في الترجمة الدبلوماسية.





ثالثاً:

استخدم أكثر من أخ وأختٍ كريمين المصطلح التالي (principle of reciprocity) ترجمةً لـ(مبدأ المعاملة بالمثل) مع أن الأخ الأستاذ عامر العظم علمنا أن ترجمة هذا المصطلح هو (principles of regularity and rotation), فهل المصطلح الذي استخدمه الإخوة والأخوات الكرام صحيح؟




رابعاً:

استخدم الأخ الكريم نضال سيف الدين خالد والأخت الكريمة مها دحام كلمة (triplicate) حيث ترجمت الأخت الكريمة مها دحام (من ثلاثة نسخ أصلية) بـ(in triplicate).

أعجبني استخدام هذه الكلمة في هذا الموضع, فهل هذا الاستخدام صحيح قانونياً؟




خامساً:

(جملةٌ أعجبتني ترجمتها):

أعجبتني كثيراً ترجمة الأخت الكريمة مها دحام للجملة التالية في المادة الثانية:


تحديد مكان وتاريخ وجدول الأعمال ومستوى المشاورات بالطرق الدبلوماسية ويعمل الطرفان على تنظيم مشاورات بشكل دوري وفقا لمبدأ المعاملة بالمثل،

Determining the venue, date, agenda and level of the consultations through diplomatic channels, both parties shall hold regular consultations on the principles of regularity and rotation

وهناك ملاحظات على استخدام بعض الكلمات في ترجمات الإخوة والأخوات الكرام, لكني آثرت انتظار المبادرات الكريمة للإخوة والأخوات الكرام بالتعليق.




أعود فأقول أني استفدت استفادةً كبيرة من ترجمات جميع الإخوة والأخوات الكرام, وليس لدي أدنى شك في قدراتهم, بل أني أجزم أن لدي أخطاءً في ترجمتي, أنتظر رأي المختصين فيها.


وما كتبته هو اجتهادات شخصية, تقبل الصواب والخطأ.

in triplicate فضلت استخدامها بدلا من التقيد بمفردة معينة لكن لست متأكدة ان كانت قانونية ام لا حيث بحثت عنها في اكسفورد لكن لم يذكر ان كانت قانونية

وبالنسبة لمبدا المعاملة بالمثل انا ايضا رغبت بأستخدام the priciple of reciprocity حيث وجدتها في القاموس تعني the priciple of mutual excahnge فيجوز أستخدامها ذلك لأنها نفس المعني وحسب ما هو موضوح في أكسفورد ولكن لا اعرف ان كان ينبغي التقيد بالمصطلح الذي قدمه لنا الأستاذ عامر العظم .

principle of reciprocity (مبدأ التبادلية) مصطلح صحيح ويجب على كل مترجم أن يستخدم محرك البحث والمصادر الرقمية لمعرفة مدى شيوع ودقة واستخدام كل مصطلح.. لدى كل مترجم أدوات رقمية هائلة يجب أن يستفيد منها ويوظفها في عمله وتطوير نفسه.

أرجو التفكير في استخدام Pursuant to و according to والبحث عن مصطلحات عبر محركات البحث لمعرفة الفرق بينهما والمصطلحات المستخدمة مع كل منهما أو طرح الموضوع على أعضاء الجمعية.
